The rule in brief

Plaza de Santa Ana, its terraces and bars

Law 5/2002 of the Community of Madrid on drug dependency and other addictive disorders (article 30.3) states that the sale and consumption of alcoholic drinks are not allowed on public roads, except on terraces, sidewalk tables (veladores) and on fair days or patron-saint festivals. The rule applies across the whole region, so in Madrid.

  • Allowed: drinking on the terrace of a bar or restaurant, inside an establishment, and at authorised local festivals.
  • Not allowed: drinking in the street, on a square or in a park, including your own bottle bought at the supermarket.

The botellón

The botellón means gathering in a group to drink shop-bought alcohol in public. This is exactly what the rule targets, and it is an administrative offence: the municipal police can issue a fine. We do not give an amount here: figures quoted online vary and we could not confirm them on an up-to-date official source. To find out, ask the Madrid city council.

For a visitor, the simplest option is to drink on a terrace: places such as the Plaza Mayor or the Retiro Park are better suited to coffee and a picnic without alcohol.

Buying alcohol

Supermarkets and wine shops sell alcohol, and the minimum age is 18: the same law bans supplying or consuming alcohol before 18. Carrying a sealed bottle in a bag is not a problem in itself; it is drinking in public that is targeted.

What to do in practice

  • For a drink outdoors, choose a terrace: you are seated, served, and it is allowed.
  • For a picnic, bring water or soft drinks; water is free at fountains (see tap water in Madrid).
